The doctrine of "qualified immunity" prevents government officials from being held liable for violating the constitution unless they are "plainly incompetent" or "knowingly violate the law.” In recent years, the Supreme Court has strengthened this doctrine, giving officials a special solicitude available to almost no other litigant. But the legal roots of this doctrine are highly questionable, and upon closer examination, qualified immunity itself may be unlawful.
