Private data markets—though which firms buy and sell data and accumulate data assets—have received sustained academic attention. But data markets are not for the private sector alone: In our federalist system, our levels of government also buy and sell data from one another. This talk will describe this intergovernmental data market and the ways it has propelled the aggregation of governmental data, complicated data governance, and raised novel legal challenges for the federalism doctrines that coordinate intergovernmental interactions.
