How does the federal government's war on diversity, equity, and inclusion intersect with equal protection law and the First Amendment?

For the Winter Quarter installment of the Diversity and Inclusion Reading Group, Professor Sonja Starr will lead a discussion about "The War on DEI as a Project of Constitutional Subversion," a new paper co-authored with Professor Genevieve Lakier. We will read the introduction plus additional excerpts focused on the Trump administration's efforts to use Title VI enforcement threats and other leverage points to stamp out DEI (including speech advancing ideas that the administration considers to entail "discriminatory equity ideology") at schools and universities. We will discuss the extent to which their arguments are supported by existing equality law doctrine, as well as the conflicts with the First Amendment.
