Q&A With Samuel Bray, Law Professor Whose Work Cited Extensively in Supreme Court's Injunction Ruling
For many legal scholars, being cited even a single time in a judicial decision is a rare and validating achievement.
That’s what made June 27 an especially momentous day in the career of new University of Chicago law professor Samuel Bray, whose scholarship on the topic of universal injunctions was cited over a dozen times by the Supreme Court in the case Trump v. CASA.
The court in CASA held that district courts lack the authority to issue these universal injunctions, which are orders blocking government officials from enforcing challenged laws or policies anywhere in the country. Prior to last month’s landmark decision ending the practice, universal or nationwide injunctions had become a feature of 21st-century presidential administrations, with courts routinely blocking the actions of Presidents Barack Obama, Donald Trump and Joe Biden.
