In this episode, I spoke with David Strauss, the Gerald Ratner Distinguished Service Professor of Law at the University of Chicago Law School. Professor Strauss holds an A.B. from Harvard College, a BPhil in Politics from Oxford University, and a J.D. from Harvard Law School. Professor Strauss is a leading expert on constitutional law. He has developed the theory that our constitutional order is one of a living constitution. We discussed Professor Strauss' theory of the living constitution, how his theory differs from originalism, and the living constitution's answer to the problem of judicial review.
