Most conservative legal scholars argue that Supreme Court decisions should closely follow the precedents set down by earlier courts. They argue, too, that the U.S. Constitution should be treated almost as sacred text.

Richard Posner is not one of those judges, though he is among the most prominent conservative jurists today.

He has written scores of books, and he moonlights as both a blogger and professor. He has heard thousands of oral arguments as a U.S. federal appeals court judge in Chicago. His latest book is Divergent Paths: The Academy and the Judiciary. With all the recent debate over the Supreme Court, there was plenty to ask him about.
