Intellectual Property Litigation: Advanced Issues

Intellectual Property litigation provides a framework for exploring complex federal civil litigation practice. This seminar will provide both insights into the practice of the trial lawyer as well as analysis of central intellectual property law concepts. Using case studies, we will examine issues such as the tactical and practical dimensions of preliminary injunction practice; the use of experts to address specialized subject matter, including the use of market research surveys to prove consumer perception; availability of equitable remedies; and persuasive trial presentation of complex facts. Trademarks and Unfair Competition is a prerequisite to taking this course, and completion of Evidence is helpful. Grades will be based on class participation, oral arguments on motions, and written briefs.
