Report Details Framework For Protecting Interests of Unaccompanied Children
The Young Center for Immigrant Children’s Rights at the University of Chicago Law School proposed a Framework for Considering the Best Interests of Unaccompanied Children, which offers recommendations for incorporating unaccompanied migrant children’s best interests into all decisions and proceedings under immigration law. It is estimated that more than 70,000 unaccompanied children will arrive at U.S. borders this year. They will be taken into federal custody, charged with violating immigration laws, and placed into deportation proceedings. Unlike other systems for protecting the rights of children, where judges and others must consider the best interests of each child, no such mandate exists under U.S. immigration law. The MacArthur-supported report lays out agency-specific recommendations to ensure every decision about a child accounts for the potential impact on the child’s safety and well-being.
