After leaving the agency in 1987, Martinez went into private practice in Denver before serving as a regional attorney for the U.S. Equal Employment Opportunity Commission from 1992 to 1996. He started his own firm in 1997, and became partner with McNamara, Roseman, Martínez and Kazmierski in 2001. He was nominated to the federal bench in February 2010 by President Barack Obama.
